Arpit Dwivedi is an Associate Partner  at KNM & Partners with over 10 years of experience advising Indian and multinational clients across sectors such as automobiles, real estate, infrastructure, hospitality, FMCG, aviation, television & entertainment, and manufacturing.

He has represented clients in several high-stakes and precedent-setting matters under the Companies Act, 2013, Insolvency and Bankruptcy Code (IBC), Arbitration & Conciliation Act, and other allied laws. Arpit has significant expertise in oppression & mismanagement litigation, complex insolvency proceedings, cross-border and domestic arbitration, and has been instrumental in advising on litigation strategies, dispute resolution frameworks, settlement structuring, and regulatory advisory.

Arpit’s work is recognized for its strategic depth and legal precision, especially in contentious insolvency matters, enforcement of foreign arbitral awards, and protecting the interests of stakeholders such as resolution professionals, lenders, and investors. His contribution in defending foreign arbitral awards against the Indian Government and his role in complex restructuring and settlement scenarios is widely acknowledged.

Key Experience

  • Insolvency & Restructuring
    • Represented a Television Company before the Hon’ble NCLAT where he successfully secured the client’s right to submit a rectified resolution plan, ensuring its consideration by the Committee of Creditors (CoC).
    • Successfully defended an insolvency petition filed by a creditor under the MSMED Act against the Television Company before NCLT Mumbai, with the tribunal ruling that interest cannot be inflated to meet IBC thresholds.
    • Successfully completed a Reverse CIRP for a real estate company, safeguarding the interests of the developer and the allottees.
    • Represented the IRP before the Supreme Court of India, where the Court ruled that an IRP cannot be held personally liable for corporate defaults regarding refund claims by homebuyers.
    • Acted for the IRP before the Delhi High Court, where the Court clarified the IRP’s obligations under the RERA Act, including the applicability of pre-deposit mandates under Section 43(5) during litigation.
  • Arbitration & Dispute Resolution
    • Successfully defended the enforcement of a foreign arbitral award under Section 37 of the Arbitration Act for an Agro Company, where the Delhi High Court upheld the principle that the Arbitral Tribunal is the master of evidence, and its findings cannot be revisited as if on appeal.
    • Represented multiple automobile, real estate, and agro companies in arbitrations, including disputes under concession agreements, project development contracts, and infrastructure disputes.
    • Advised and represented clients in international commercial arbitration, cross-border disputes, and enforcement of awards.
  • Litigation Strategy & Advisory
    • Advises clients on litigation strategy across insolvency, corporate, and commercial laws.
    • Regularly advises clients in complex, multi-stakeholder settlements, including negotiation, drafting, and execution of settlement documentation in high-stakes disputes.
