Sakshi Kapoor is a Senior Associate at KNM & Partners with more than seven years of experience providing strategic legal counsel to Indian and international clients across a wide spectrum of industries, including real estate, infrastructure, automobiles, manufacturing, and media.

She specializes in complex commercial disputes with a focus on insolvency proceedings, shareholder and joint venture conflicts, and arbitration. Sakshi regularly represents clients in proceedings before the National Company Law Tribunal (NCLT), National Company Law Appellate Tribunal (NCLAT), High Courts across jurisdictions, and the Hon’ble Supreme Court of India. 

Her work covers end-to-end dispute resolution and representation before judicial and arbitral forums. She is also proficient in handling arbitrations and regulatory matters, with experience in both domestic and cross-border disputes. She plays an active role in drafting pleadings, examining witnesses, and arguing matters across judicial and quasi-judicial bodies.

She also has experience in handling corporate insolvency and shareholder litigation matters, both substantive and procedural law. She also has considerable experience in writ jurisdiction and regulatory litigation involving actions taken by State authorities, having appeared in matters involving constitutional and administrative challenges

Key Experience

  • Insolvency and Restructuring
    • Represented a media company before the NCLAT, securing its right to revise and resubmit its resolution plan for consideration by the Committee of Creditors.
    • Successfully defended an airline company engaged in comprehensive aircraft charter services before the NCLT, where the Tribunal ruled that the petition filed under Section 9 of the Insolvency and Bankruptcy Code was not maintainable
    • Successfully defended an MSMED-triggered insolvency petition, with NCLT ruling in favor of the client on threshold applicability under IBC.
    • Advised and completed Reverse CIRP for a real estate developer, ensuring protection of homebuyer interests and all stakeholders.
    • Represented a landowner in CIRP proceedings where development rights had been granted to a developer undergoing insolvency.
    • Appeared for an investment fund in insolvency proceedings involving debenture defaults by a prominent real estate group.
    • Regularly represents financial and operational creditors, as well as corporate debtors, in CIRP and post-admission proceedings.
    • Represented personal guarantors in proceedings before the NCLT.
  • Shareholder and Joint Venture Dispute
    • Represented shareholders and promoters in high-stakes disputes involving oppression and mismanagement under the Companies Act, 2013.
    • Advised on enforcement and interpretation of shareholders’ agreements and JV terms before the NCLT.
  • Arbitration & Dispute Resolution
    • Represented real estate developers in arbitrations concerning delays and breaches in government-related development contracts.
    • Handled commercial arbitrations involving project development and infrastructure contracts, particularly real estate sectors.
    • Advised clients on international arbitration matters and enforcement of foreign arbitral awards in India.
    • Represented stakeholders in disputes between landowners and developers under complex development agreements.
